By requesting a quote, scheduling a consultation, or contracting with Kefiku for fence installation services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, please do not use our services.

2. Services Provided

Kefiku specializes in professional fence installation services, including but not limited to:

  • Residential and commercial fence installation
  • Custom fence design and consultation
  • Fence repair and maintenance services
  • Material sourcing and delivery
  • Post-installation support and warranty services

All services are subject to availability, site assessment, and mutual agreement on project specifications and pricing.

3. Quotes and Pricing

All quotes provided by Kefiku are estimates based on the information provided by the client and initial site assessments. Final pricing may vary based on:

  • Actual site conditions discovered during installation
  • Changes requested by the client after quote acceptance
  • Unforeseen obstacles or complications (underground utilities, rock formations, etc.)
  • Material price fluctuations

Quotes are valid for 30 days from the date of issue unless otherwise specified. We reserve the right to adjust pricing after this period.

4. Payment Terms

Payment terms will be outlined in your service agreement. Typically, our payment structure includes:

  • A deposit of 30-50% upon contract signing to secure materials and scheduling
  • Progress payments as agreed upon for larger projects
  • Final payment due upon project completion and client approval

Accepted payment methods include cash, check, credit card, and electronic bank transfer. Late payments may incur additional fees as specified in your service agreement.

5. Project Timeline and Delays

Kefiku strives to complete all projects within the agreed-upon timeline. However, project completion may be delayed due to:

  • Adverse weather conditions
  • Permit delays or regulatory issues
  • Material delivery delays from suppliers
  • Client-requested changes or modifications
  • Unforeseen site conditions

We will communicate promptly regarding any delays and work diligently to minimize impact on the project schedule.

6. Client Responsibilities

To ensure successful project completion, clients agree to:

  • Provide accurate property information and site access
  • Obtain necessary permits and approvals (unless otherwise agreed)
  • Mark or identify underground utilities before work begins
  • Ensure pets are secured during installation
  • Remove obstacles or items that may interfere with installation
  • Provide timely feedback and approvals as requested

7. Warranty and Guarantees

Kefiku stands behind the quality of our workmanship. We provide:

  • A workmanship warranty covering installation defects for a specified period (as outlined in your service agreement)
  • Material warranties as provided by manufacturers
  • Commitment to address any installation-related issues promptly

Warranties do not cover damage resulting from natural disasters, client modifications, normal wear and tear, or lack of recommended maintenance.

8. Limitation of Liability

Kefiku's liability is limited to the total amount paid for services rendered. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Damage to underground utilities not properly marked
  • Property damage resulting from client-provided inaccurate information
  • Delays caused by factors beyond our reasonable control

9. Cancellation and Refund Policy

Cancellations must be submitted in writing. Refund eligibility depends on project stage:

  • Cancellations before material ordering: Full refund minus administrative fee
  • Cancellations after material ordering: Refund minus materials ordered and administrative costs
  • Cancellations after work commencement: No refund; payment for completed work required

10. Intellectual Property

All custom designs, plans, and materials created by Kefiku remain our intellectual property unless otherwise agreed in writing. Clients may not reproduce or share these materials without express permission.

11. Privacy and Data Protection

We respect your privacy and handle personal information in accordance with applicable privacy laws. Information collected is used solely for service provision and communication purposes. We do not sell or share client information with third parties except as necessary to complete services.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the laws of Ontario, Canada.

13. Modifications to Terms

Kefiku reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services after modifications constitutes acceptance of updated Terms.

14. Governing Law

These Terms and Conditions are governed by the laws of Ontario, Canada. Any legal proceedings shall be conducted in the appropriate courts of Toronto, Ontario.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
